Immigration/DACA:

Trump took time out from his Easter festivities to announce that he was closing the window on any sort of DACA deal. We all know the complexities of this issue. Deporting a single DACA recipient will break up households where other family members have citizenship. It would also be sending people back to countries they never really knew, and in some cases, DACA recipients have no meaningful ties to people living in their native country. It would also be economically devastating, taking thousands of taxpaying workers out of the economy. We need a legitimate DACA fix that will provide DACA-eligible residents with a path to citizenship.

Oppose Trump’s Ban on Transgender Troops Serving in the Military:

Late Friday evening, while everyone was obsessed with the Stormy Daniels story, the White House and Pentagon announced that all transgender individuals with a history of gender dysphoria or who have undergone gender transition will be disqualified from military service. Final details remain unclear, including whether this applies to future enlistments or those currently serving, but once again Trump is attacking qualified people who simply want nothing more than to serve their country. Previous court injunctions prevented the initial ban from going into effect, but the Department of Justice is prepared to defend the new version in federal court.

Senator Tillis has been more directly implicated in the Cambridge Analytica scandal. His campaign may have been the beneficiary of data obtained by Cambridge Analytica during the 2014 election. As you will no doubt recall, Tillis had a closely contested election with Kay Hagan in one of the most expensive Senate elections in US history. WRAL is reporting that North Carolina voters were among the first in the U.S. to be targeted by Cambridge Analytica, which boasted that its "psychographic data" could be used to build personality profiles of voters and target individualized political ads at them to influence their behavior. WRAL is also reporting that Tillis’s campaigned paid CA $30,000 and that the North Carolina Republican Party paid it another $150,000. So far, Tillis has dodged questions about his use of CA data and even bolted from the Senate floor to avoid reporters. Let’s demand some answers.

BONUS FEDERAL ACTION:

Protect Mueller:

John Dowd is out, a lawyer long credited with keeping Trump from mentioning, let alone firing, Special Counsel Robert Mueller. In comes Joseph diGenova, another shrill talking head from Fox News spouting wild conspiracy theories about Clinton, the FBI, and the Justice Department, the sort of depraved diminution of our nation’s critical intelligence community Trump has traded in ever since he has been in the crosshairs of investigations. Tepid assurances from GOP leadership that there is some kind of “red line” do nothing to stem the darkening clouds on the horizon that portend a collision between our POTUS and Mueller. Mitch McConnell will be fiddling while Trump burns the Constitution at this rate. We must demand that our reps at least nominally, if not legally, protect Mueller. Senators Coons and Tillis have long sponsored a bill that would do make it much more difficult for Trump to summarily fire the Special Counsel. It’s time Congress acted on it.

TILLIS BLOCKS DREAM ACT!

Democratic Sen. Dick Durbin made a last-ditch effort to pass the DREAM Act -- a bill granting citizenship to undocumented immigrants brought to the US as children -- before the senate voted on the massive GOP spending bill that includes no fix for DACA, by asking for unanimous consent.

Under a consent request, any one senator can block a bill from being passed. Our very own Thom Tillis objected to Durbin's request, which killed the chance for the DREAM Act. Instead, Tillis asked him to modify his request so that the Senate could instead pass a bill that largely aligns with Trump's wishes. The bill Tillis supports would allow a pathway to citizenship BUT would add $25 billion in border security, eliminate the State Dept's visa lottery and enact new limitations on family-based immigration.

Let's let Senator Tillis know just how unhappy we are with him and his alignment with the outrageous immigration requests from the White House and his willingness to use DACA recipients as political pawns.

Secure Our Elections

The soft hacking of the 2016 election by Russia and other actors has gotten much attention, as has the scandal involving the Facebook data breach and Cambridge Analytica. However, less widely publicized is that the Russians attempted to hack into the election systems of nearly two dozen states, and were successful in Illinois. Apparently they were not able to alter any data, but the need for immediate action is critical. On Wednesday, officials from the Department of Homeland Security faced tough questions in the Senate, but questions alone are not going to ensure fair elections in November. Our nation needs to allocate the resources necessary to update voting machines, many of which are over ten years old and thus imminently hackable.

End the War in Yemen: Cut Saudi Military Aid

According to the New York Times, some 8 million Yemeni people are on the brink of starvation because of Saudi Arabia’s brutal blockade and continued bombardment. It is true that the rebelling factions within Yemen are allied with Iran, but the people are suffering needlessly due to the Saudis’ outrageous disregard for human rights. Meanwhile, crown prince Mohammed bin Salman cozies up to Trump in the Oval Office, discussing, no doubt, additional “deals” that will further militarize the Saudis. A bipartisan measure to end U.S. involvement died in the Senate. We must urge our representatives to withhold military aid to Saudi Arabia until that nation ceases its barbaric practices that threaten the lives of millions of innocents.

We now have even more details about Cambridge Analytica’s use of Facebook data to influence both the 2014 and 2016 elections. Cambridge Analytica was permitted by Facebook to access the personal data of over 50 million users. While Facebook did allow this access, it is clearly a breach of our personal data, one that makes it much more difficult to trust Facebook. In addition, a whistleblower is alleging that Steve Bannon oversaw Cambridge Analytica’s use of Facebook’s data.

Protect Special Counsel Robert Mueller

The Mueller investigation hangs by a thread, as Trump fumes and Congress twiddles its thumbs. The silence from leadership, particularly Mitch McConnell, is deafening. No collusion? McConnell and other top Republicans are colluding with Trump to undermine the only untarnished, non-partisan, fact-based inquiry into Russian meddling into our elections left standing. Only John McCain and lame duck Jeff Flake are really making any noise about this. It is absolutely unconscionable that our elected representatives have so little to say about the undemocratic and unjustified firing of FBI Deputy Director Andrew McCabe and about Trump’s unhinged attacks on Mueller.

Support Net Neutrality:

Democrats in both the House and the Senate have introduced legislation that would overturn the FCC’s decision to revoke net neutrality rules. Net neutrality is the backbone of a free internet, and without these protections, ISPs could throttle, slow down, or even block content that they don’t like. It could also allow ISPs to charge consumers more for certain types of content. Democrats have a 60-day window to use the Congressional Review Act (CRA) to scrap with a simple majority the FCC’s order to end net neutrality rules, which started last week after the order was officially published in the Federal Register. During this 60-day window, the Senate would just need a simple majority to overturn the FCC order. One GOP Senator, Susan Collins has already signed on, so we need just one more Republican.

Trump Must Condemn UK Poisoning and Enforce Sanctions:

The brazen attack on British soil of a former Russian spy and his daughter by the Russian government is just the latest example of the lawlessness of the Putin regime. Yet, through it all, Trump says nothing. Congress enacts, with near unanimity, tough sanctions on Russia, and Trump flouts the law by refusing to enforce them. Questions swirl about Russia’s near-certain hacking of our election, and Trump calls the whole thing a hoax and a witch hunt. We can only imagine what secrets lie with Putin that cause our president to cower before him, but we must ask our legislators to speak out and for them to demand that Trump do the same. How many more will die? How many more elections will be hacked? How much more political divisiveness will be sown while our government sits on its hands?

Gun safety:

After a freewheeling event in which he seemed to defy the NRA and open the door for raising the age to purchase some guns to 21, Trump has now predictably caved to pressure from the gun lobby and is now pivoting toward “hardening” schools. He claimed that there was “not much political support” for raising the age. Let’s call our reps and let them know just how much support this and other sensible gun control measures have.

STOP THE SNEAKY ROLLBACK OF DODD-FRANK PROTECTIONS - VOTE THIS WEEK

The Economic Growth, Regulatory Relief and Consumer Protection Act, S. 2155, is a sneaky rollback of the Dodd-Frank regulations on financial institutions, which were implemented after the 2008 global financial crisis. Current Dodd-Frank regulations require banks valued at $50 billion or more to undergo annual "stress tests" and be closely monitored, but S. 2155 would increase the valuation threshold for monitoring to $250 billion and exempt foreign institutions like Deutsche Bank altogether. Banks valued at $10 billion or less would also be allowed to sell high-risk mortgages and participate in certain financially risky investment activities. The bill would also eliminate protections for minority consumers, such as reporting requirements designed to help regulators and Congress track racially discriminatory patterns in lending.

S. 2155 was initially described as a pro-consumer, pro-small bank bill designed to ease regulatory burdens. The bill includes a few pro-consumer provisions like free credit freezing and safeguards for foreclosure victims; however, these small concessions are far outweighed by provisions like a ban on suing credit agencies like Equifax for exposing customers’ data to hacks. Overall, the bill encourages the banking industry to resume the kind of risky profiteering that created the global financial crisis of the last decade. Indeed, the nonpartisan Congressional Budget Office has concluded the bill makes it significantly more likely that major financial institutions will once again require government bailouts due to irresponsible lending practices. Further, the supposedly beleaguered small banking sector has seen significant growth under current regulations, indicating that further deregulation is unneeded. While S. 2155 is an unnecessary and dangerous rollback of regulations on the banking industry, it has support from up to 17 Independents and Democrats in the Senate; Congress must hear loud and clear that their constituents support strong banking regulations

DEMAND EXECUTIVE ACTION TO PREVENT RUSSIAN CYBER ATTACKS

Top US intelligence officials, including US Cyber Command chief and National Security Agency (NSA) director Adm. Michael Rogers, have repeatedly warned Congress that they expect Russia to interfere with our 2018 midterm elections. Despite these repeated admonitions, the Trump administration has issued no orders for Cyber Command or the NSA to disrupt anticipated Russian cyberattacks.

Rogers (who will soon be replaced by Lt. Gen. The deadline for a DACA bill has once again passed without any meaningful legislation, once again leaving DACA recipients and their families in limbo. We all know the complexities of this issue. Deporting a single DACA recipient will break up households where other family members have citizenship. It would also be sending people back to countries they never really knew, and in some cases, DACA recipients have no meaningful ties to people living in their native country. We need a legitimate DACA fix that will provide DACA-eligible residents with a path to citizenship.

Reject Kyle Duncan and Thomas Farr’s Appointment to the Federal Judiciary:

Many of us in North Carolina are well aware of judicial nominee, Thomas Farr. Farr’s nomination cleared the Senate judiciary committee, and now he is awaiting confirmation by the full Senate. Given Farr’s record in defending voter suppression and other attacks on civil rights, it is absolutely essential that we try to prevent him from getting a lifetime appointment. Farr has worked for decades to intimidate and disenfranchise black voters. He was likely involved in a scheme in which Jesse Helms’ campaign sent over 100,000 postcards to African-American voters, incorrectly telling them they were ineligible to vote and threatening them with jail time if they attempted to cast a ballot. He also participated in the creation of North Carolina’s voter photo ID law, which was struck down by the 4th U.S. Circuit Court of Appeals for discriminatory intent. In addition, he helped the GOP-controlled NCGA create the 2011 electoral maps that were rejected as unconstitutional by the Supreme Court because of racial gerrymandering.

Kyle Duncan is equally bad. According to the New York Times, he has played a leading role in opposing the provision of the Affordable Care Act requiring employers to provide insurance coverage for contraceptives. Mr. Duncan also defended North Carolina’s photo ID law that the Court of Appeals for the Fourth Circuit wrote had targeted black voters “with almost surgical precision.” He also defended Louisiana’s ban on gay marriage in several different courts before the Supreme Court prohibited state bans on gay marriage.

Note: If you have some time, call some moderate GOP Senators, possibly Flake (AZ), Kennedy (LA), Collins (ME), Heller (NV), and Murkowski (AK). Tillis and Burr are likely all-in on Farr and Duncan, but we can at least make their staffers’ ears buzz with a few hundred phone calls.

Oppose Three State Constitutional Amendments:

Bob Steinburg (R-Chowan) announced that the NC GOP will try to push three constitutional amendments during the May NCGA session. A legislatively referred constitutional amendment can go on the ballot if 60% of the members of each chamber of the North Carolina State Legislature adopt an act submitting the proposed amendment to a statewide vote. The legislature can determine the date of the election on a proposed amendment. The three amendments would be: (1) an amendment mandating voter ID (which has already been ruled unconstitutional); (2) an amendment affirming the “right to hunt and fish” (which is unnecessary but popular with the NRA crowd); and (3) an amendment capping the state income tax at 5.5%. All of these amendments are pretty clearly designed to drive out disaffected conservative voters who will support the “right to hunt and fish” and will also support voter ID, allowing the GOP to suppress thousands of NC voters. And while the GOP can set any date for a vote on these amendments, it seems logical they would put these on the November ballot to drive up turnout. Democracy NC has been sounding the alarm bells about this on Twitter, so it’s worth making a few calls.

Protect the Consumer Financial Protection Bureau:

A deregulatory bill, S.2155, introduced by Republican Senator Mike Crapo of Idaho, chairman of the Senate Banking Committee, proposes a major rollback of the 2010 Dodd-Frank Act. Dubbed The Economic Growth, Regulatory Relief, and Consumer Protection Act, the bill would undermine many of the key protections offered by the Consumer Financial Protection Bureau. Specifically, it would prevent the CFPB from collecting key data showing when and where families of color are being overcharged for home loans or steered into predatory products. There are other protections that would be weakened or eliminated by this bill, and unfortunately approximately Democrats in swing states or with ties to the financial industry (cough--Schumer--cough) voted for the motion to proceed to allow the Senate to vote on the bill. Now, the bill just needs a 50-vote majority (Pence would cast the tie-breaking vote). We can and should call Tillis and Burr, but also consider calling, tweeting, or emailing the Senate Democrats who voted for the motion to proceed and ask them to reconsider their support of this awful bill.

Prevent Doctors from Discriminating Against LGBTQ Patients:

It got lost in all the other news but the Trump-Pence GOP has issued guidelines via the Health and Human Services Department that would include a “Conscience” provision that would allow medical providers to discriminate against LGBQT patients and would also allow doctors to ignore patients’ wishes on reproductive choices. This is done through the formation of a new Conscience and Religious Freedom Division in the HHS Office for Civil Rights (OCR), established back in January. I’m largely borrowing a script from the Human Rights Campaign, but both the HRC and the ACLU have sounded the alarm on this policy.

The NCGA has created a panel to explore the issue of how to make our schools safer and less prone to gun violence. One idea that is being tossed around is the suggestion to arm teachers. Support Net Neutrality:

Democrats in both the House and the Senate have introduced legislation that would overturn the FCC’s decision to revoke net neutrality rules. Net neutrality is the backbone of a free internet, and without these protections, ISPs could throttle, slow down, or even block content that they don’t like. It could also allow ISPs to charge consumers more for certain types of content. Democrats have a 60-day window to use the Congressional Review Act (CRA) to scrap with a simple majority the FCC’s order to end net neutrality rules, which started last week after the order was officially published in the Federal Register. During this 60-day window, the Senate would just need a simple majority to overturn the FCC order. One GOP Senator, Susan Collins has already signed on, so we need just one more Republican.

AUTHORIZE THE CDC TO RESEARCH GUN VIOLENCE:

The Centers for Disease Control is prohibited from studying gun violence. This is due to a rule informally known as the Dickey Amendment, which prevents federal funding to be used to advocate for or promote gun control.Senator Ed Markey has proposed a bill, SB 834, that would rescind the Dickey Amendment and authorize $10 million in annual funding for that research. It’s pretty clear from other studies that reasonable restrictions on gun sales would likely make us safer, but having the weight of federally-funded research would be enormously helpful.

STOP THE SNEAKY ROLLBACK OF DODD-FRANK PROTECTIONS - SENATE TO VOTE TUES 3/6


S.2155 (The Economic Growth, Regulatory Relief and Consumer Protection Act), is a sneaky rollback of regulations of "too big to fail" financial institutions put in place after the global financial crisis. Current Dodd-Frank regulations require banks valued at 50 billion or more to undergo annual "stress tests" and be closely monitored, but if S. 2155 becomes law that threshold will increase to $250 billion. Other troubling provisions of this bill include allowing banks valued at $10 billion or less to sell high-risk mortgages, exempting those same banks from the Volcker Rule prohibiting them from participating in financially risky activities, and allowing hedge funds to share the name of banks as a way of enticing investors to uninsured investment funds.

Although there are a few pro-consumer provisions like free credit freezing, protections for veterans, and safeguards for foreclosure victims, the overall effect of the bill is to encourage the banking industry to resume the kind of risky profiteering that created the global financial crisis of the last decade. While this law purports to support the community banking industry, this supposedly beleaguered sector has seen significant growth under current regulations, indicating that further deregulation is not needed or helpful. S. 2155 is an unnecessary and dangerous rollback of regulations on the banking industry.

IMPLEMENT RUSSIA SANCTIONS

On the January 29th deadline to implement Russian sanctions passed into law by Congress, the Trump administration announced it has decided to not implement new sanctions, stating "If the law is working, sanctions on specific entities or individuals will not need to be imposed because the legislation is, in fact, serving as a deterrent."

The law codifies Obama era sanctions imposed by executive order at the end of last year, extending sanctions to individuals engaged in malicious cyber activity or selling weapons to the Assad regime in Syria, and it defines new sanctions to be enforced against Iran for violations of human rights and continuing weapons program activities. Critically, the bill gives Congress the ability to review and reject any proposed lifting of sanctions against Russia by the Trump Administration.

In light of the President’s continued inability to draw a clear line with Putin and implement the sanctions, it is important to keep visibility and momentum on this critical check on the Administration’s power in dealing with Russia.

But the law does not mandate any federal funding, so with that in mind, our second state and federal calls are going to be linked today. For Congress, we are going to call on them to provide federal funding for this important piece of legislation. And we’re going to follow that up with a call to the NCGA to pass a state-level Survivors’ Bill of Rights AND to provide adequate funding to support survivors of sexual assault.

Let’s keep the pressure on our lawmakers to do something about gun violence for at least one more day. Public pressure seems to be having at least some impact. Companies are cutting ties with the NRA. Trump has expressed some openness to banning bump stocks, making background checks more rigorous, and raising the minimum age to purchase guns to 21. I’m not counting on him to do any of those things (and he apparently backed down from some of that later in the day after having lunch with the NRA), but we need to make sure that our representatives know where we stand on gun safety.

OPPOSE H.R. 38, THE CONCEALED CARRY RECIPROCITY ACT, & HOLD HOUSE RESPONSIBLE FOR PASSING IT.

The gun lobby’s top priorities enjoy wide support in Congress. On December 6, 2017, the House of Representatives passed H.R. 38, the Concealed Carry Reciprocity Act. This legislation was a top priority of the National Rifle Association (NRA) and, if enacted into law, would cause a race to the bottom on gun safety standards. The Senate is expected to take up this same bill this year. We can’t let that happen.

Under this legislation, states would be required to recognize other states’ standards governing the possession of concealed firearms in public. This means that even though one state may have stringent regulations such as a permit or training requirement, that state would have to allow people from other states with lower standards - with perhaps no permit or training required at all - to carry concealed firearms without following the more stringent regulations.

This legislation would deprive states and localities from fully determining the appropriate gun safety protocols for their communities, and would allow the lowest common denominator to prevail. This will make concealed and loaded firearms more readily available at lower safety standards, raising the risk of gun violence for everyone.

For those reasons, every major law enforcement association opposes this bill because of its potentially disastrous implications for public safety. After all, this legislation would make it easier for more dangerous people, like stalkers, domestic abusers, and people who have committed violent crimes to carry loaded, concealed guns in more public places. This makes the risk of violence more imminent for all of us.

SUPPORT EXPANDED BACKGROUND CHECKS FOR GUN PURCHASES

In light of recent mass shootings in Florida, Las Vegas, Texas, and other cities across the country, it is clearer than ever that our approach to gun policy and gun violence must change. One such necessary change is to close background check loopholes. Currently, background checks are mandatory for commercial gun sales but not for purchases made through private sellers, at gun shows, or online.

To fix this serious problem, Senator Chris Murphy (D-CT) introduced the Background Check Expansion Act, along with 31 Democrat co-sponsors, which would make background checks nearly universal. The bill would close the "gun show loophole" by mandating that all sellers run potential buyer information through the FBI's National Instant Criminal Background Check System (NICS). It would also require a licensed firearms dealer run a NICS check on buyers purchasing a gun from a private seller. The bill maintains some exceptions for law enforcement officials, loans for hunting and sporting events, or for immediate self-defense.

Sen. Murphy has been working to pass the expansion of background checks since 20 Newtown children were killed in his state. While he acknowledges the tough hurdles such legislation faces, especially from the NRA, public support for expanded background check has risen to 90%. Two of the 5 deadliest mass shootings in modern U.S. history happened in the span of 35 days this fall. The time for Congress to finally take action against rampant gun violence in this country is now.

SAVE THE AMERICANS WITH DISABILITIES ACT (ADA)!

Last week, the House of Representatives passed H.R.620, the ADA Education and Reform Act of 2017, which removes incentives for businesses to proactively ensure that their establishments are accessible to people with disabilities.

Today, people with disabilities can sue inaccessible businesses that refuse to comply with ADA regulations. If H.R.620 becomes law, people with disabilities will have to notify businesses of any obstacles to access, wait six months for the business to act to address those issues, and will only then be able to take the business to court.

H.R.620 also protects businesses from any penalties for noncompliance, as long as they can show "substantial progress" in fixing issues. In practice, this means that people with disabilities could be forced to wait for access for months or even years while businesses “make progress” but don’t actually remove the obstacle/s. (Imagine your local grocery store telling you: “We’re building that ramp, but it’s going to take three years.”)

Now that H.R.620 has passed in the House, the bill goes to the Senate for consideration. Call your senators and tell them to vote NO on H.R.620 and PROTECT THE ADA!

DEMAND A FEDERAL BAN ON ASSAULT WEAPONS

In 2004, the NRA successfully pressured the Republican-controlled government into not renewing the 1994 Federal Assault Weapons Ban. The ban had worked to protect lives: after it expired the number of gun massacre deaths (which had decreased over 40% during the ban) jumped nearly 2.5 fold.

Gun violence experts are now renewing their calls for a nationwide ban on these types of weapons - and Americans agree - recent polls show at least 2/3 of Americans support a nationwide assault weapons ban. In November of last year, Senator Dianne Feinstein introduced an assault weapons ban (S.2095). This bill would ban future sales of high-capacity magazines and military-style assault weapons, including the AR-15 used in many recent gun massacres (Parkland, Las Vegas, Newtown). Legislators must act now before any more lives are needlessly lost.

LET THE CDC STUDY GUN VIOLENCE: REMOVE THE DICKEY AMENDMENT

For nearly 20 years, the Centers for Disease Control and Prevention (CDC) have been subject to a ban on funding to study gun violence. In 1996, the National Rifle Association (NRA) convinced Rep. Jay Dickey (R-AR) to insert language into an omnibus spending bill to prohibit the CDC from using any of their injury prevention funding for research that "advocate[s] or promote[s] gun control".

The so-called Dickey Amendment has appeared in every subsequent appropriations bill for almost 20 years and suppressed crucial efforts to study gun violence and how to reduce it. The NRA staunchly insists that any gun control research is part of an "anti-gun agenda," but even Rep. Dickey has disputed the NRA's highly politicized characterization of the CDC's scientific research.

As the nation reels from yet another horrific school shooting, this time in Florida, it is long past time for Congress to end the NRA's tyrannical suppression of essential public health research. Urge your representatives to end the Dickey Amendment today.

Congress still has time to act before the March 5 DACA cliff, when 1,200 DACA recipients will begin to lose their protections every single day. They'll have a week before then to pass legislation providing relief for Dreamers -- but it'll require Republicans rejecting Trump's racist demands. It's important for you to tell your MoCs to do their job and protect their communities by passing a clean Dream Act now.

We want a “clean” Dream Act, which provides relief for Dreamers but that does not further fund or expand Trump’s deportation machine. Short of the Dream Act, we need to push for as limited a bill as possible. It must include relief for Dreamers, but should not include the harmful, nativist provisions that the White House has proposed.

Our two Senators aren’t up for reelection this term, but we could support Congressional candidates who stand up for gun safety.
